Terms & Conditions

Last updated: May 26, 2026

Welcome to Foodie POS. These Terms & Conditions govern your subscription and use of the Foodie POS Point of Sale system, kitchen displays, Tableside QR ordering modules, and cloud analytics dashboards provided by SB Dev Studio. By activating an account or utilizing our software, you agree to comply with these terms.

1. SaaS Subscription & Service Limits

Foodie POS is licensed as a Software-as-a-Service (SaaS) subscription. Your active subscription records dictate the exact limits of your restaurant networks:

  • Max Outlets Allowed: Bound by your plan limits (defaulting to 1 branch for basic tiers).
  • Max Staff Accounts: Restricted by your active tier (defaulting to 5 active accounts for starter tiers).

Exceeding these limits requires a subscription tier upgrade or custom plan configuration enabled on your branch outlet.

2. Billing, Dynamic Pricing & Invoices

  • Price Updates: Subscriptions are billed monthly or yearly. Active plans configurations, monthly rates, and yearly coefficients are managed dynamically via our cloud database.
  • Custom Constructor Plans: Selecting modular integrations in our builder (Core POS, WhatsApp, Delivery partner API, Ordering App) dynamically increments your monthly rate according to current database modules pricing.
  • Invoices: Digital receipts will be compiled and sent to the merchant's registered business email upon successful transaction cycles.

3. Tax and GST Settings Compliance

Merchants are solely responsible for configuring accurate tax percentages and providing legal GSTIN identifiers, corporate names, and state routes.

Foodie POS automatically computes order totals, tax amounts, and rounding adjustments based on your custom rule configurations. SB Dev Studio holds no responsibility for incorrect tax filings or cashier splitting differences logged in payment splits tracking.

4. Local Cache & Sync Engine Responsibility

Foodie POS utilizes a local device cache allowing cashiers to take orders offline during internet drops. Merchants acknowledge that:

  • Offline cached orders generate local sequence queues. Terminals must be reconnected to the internet within 48 hours to sync to our cloud databases safely.
  • SB Dev Studio is not liable for data loss or cashier total conflicts arising from long-term offline operations across multiple desynced device terminals.

5. Intellectual Property Rights

All application software layouts, interactive cashiers simulation panels, database structures, and kitchen ticket routing configurations are the exclusive intellectual property of **SB Dev Studio** and its founder **Sharnabh Banerjee**. You may not copy, reverse-engineer, redistribute, or build duplicate products using our codebases without an explicit Enterprise white-label license contract.

6. Limit of Liability & Server Outages

While we run on top-tier cloud backbones (Vercel, Supabase) ensuring highly scalable uptimes, Foodie POS is provided on an "as-is" and "as-available" basis. SB Dev Studio is not liable for business revenue losses, receipt printer hardware failures, or staff billing latency arising from server outages, third-party network glitches, or regional internet blocks.

7. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Ghaziabad, Uttar Pradesh, India.
